TERMS OF SALE

By placing an order at Kalk you are subject to these terms and conditions in full.

In order to purchase, access our services or enjoy our promotions at Kalk you must be over 18 years of age and have the capacity to contract. It is mandatory to fill in the registration form in full. When placing an order you undertake that all details you provide to us are true and accurate. Kalk reserves the right to refuse or exclude any customer not complying with these requirements.

BUYING AT KALK

Users must fill in all required fields at Kalk to make a purchase.

All prices shown are final prices, expressly including the Value Added Tax (VAT) in those cases that apply, notwithstanding that the user will at all times have detailed information of the price of the product.

Acceptance of present conditions implies conformity with the product, its characteristics and its price.

All orders require the acceptance of prices and product characteristics as detailed in its product description.

In case any product is not available, Kalk will notify the customer as soon as possible, cancelling the order and refunding the amount to the customer.

All our products have a two-years warranty against manufacturing defects. This warranty does not cover damages for misuse or normal wear and tear.  For a correct conservation of your Kalk products you must follow the advices collected in our Jewellery Care guide.

In case of defective product, the seller should proceed to repair, replace, low the price or resolute the contract, actions which will be complementary for the consumer and user. This gratuity shall include the costs needed to correct the lack of conformity of the defective products, especially the s&h costs, as well as those related to materials and workforce.

The seller should respond to the lack of conformity due to defective product that may appear in a 14 days period since the delivery. Consumer and user should inform to the seller about the lack of conformity in a 14 days period since they have noticed it.

Before customer and user gets linked to any distance contract, or settled out of the establishment or any correspondent offer, Kalk will give the needed information about the existence of customer and user post-sale assistance, post-sale services and commercial guarantees, as well as its conditions.

PRODUCT PRESENTATION

Kalk is committed to show and describe the products as accurately as possible.

Kalk denies all responsibility in case of a mistake, error or omission in said presentation. Photographs used to illustrate and complement the products description do not belong to the contract obligations.

PAYMENT

All orders must be paid using a bank card (Visa or Mastercard) or through a Paypal account.

Kalk will never store card details or bank details of its users in its server. It is not allowed to use data or payment instruments belonging to third parties.

PAYMENT SECURITY

Kalk will use all available means to guarantee the confidentiality and security of the data transmitted through the web and on the website www.kalkstore.com.

In the same spirit, the payment platform uses SSL (Secure Socket Layer) security protocols.

PRE-ORDERS

At Kalk you can pre-order the items not yet available. Just buy the article you want in the usual way and please be aware of the estimated shipping date. The order will ship once the pre-ordered item is ready.

If your order contains articles both in stock and available for pre-order, it will only be shipped once all items are available.

You can identify those items available for pre-order by the estimated shipping date message on your screen. The return period of the orders that contain reserved items will start once the order has been received.

SHIPMENT

  • Our orders have an estimated delivery time of 24/72 hours (for Spain and Portugal, rest of countries see chart below). The estimated delivery time may be affected in the event that your order contains products in pre-order or during promotional periods (such as Sales, Black Friday, Christmas...)
  • Orders shipped to Mexico will ship once a week with an estimated delivery time of 7 to 14 working days.
  • Once your order ships, you can track it using the “Order Tracking” section, by entering your e-mail and the order number we provided in the order confirmation e-mail.
  • For shipments to Spain, the courier company responsible for the distribution and transport of all our orders is Correos. In case of absence at the time of delivery, the messenger will contact you to agree a schedule that best suits your preferences. If the delivery does not occur in any case, your order will be deposited for collection at your local Post Office.
  • Besides it is the customer’s responsibility to check the product upon receipt to verifiy it is in prefect state. If the box seems either to be open or the customer may think the shipment has been tampered with, the customer must refuse the delivery and notify Kalk immediately through this Contact Form.
  • Inside the parcel you will find each one of the items in its respective packaging, usually each piece is individually packaged.
  • Occasionally, shipments to countries outside the EU may incur additional fees and taxes, which in all cases will be the responsibility of the buyer. In Kalk we commit ourselves to carry out the procedures by preparing the necessary paperwork for the corresponding customs management.
  • You will find below a chart showing the shipping costs and delivery times for each different country. Please, have in mind that free shipping will not apply if the grand total of your order does not reach the minimum amount required for free shipping, once you apply a discount or promotion.

    RETURNS POLICY

    All items purchased from Kalk through our website may be returned within a maximum period of 14 calendar days from the date the order was delivered.

    Returns will be managed through our Returns Portal. Kalk will only assume the cost of returning defective products previously managed and accepted by the Quality Department through the following link: Customer Service.

    For hygiene reasons, we do not accept exchanges or returns of bikini bottoms, swimming costumes, piercings, ear cuffs, earrings and/or masks.

    Products purchased through 2x1 promotions cannot be exchanged or returned.

    Please note that if your order included a gift and you make a complete return, you must also return the gift. Otherwise, the value of the gift will be deducted from the final refund amount.

    It is essential that the products you wish to return are in perfect condition, with no obvious signs of use and that they are returned in their original packaging, otherwise the return will be rejected and the refund will not be made.

    In the event of refusal, the customer will have 3 months to collect and/or collect their order from the central facilities, at their own expense. If the package has not been collected within 3 months, it will be handed over to the charity.

    We offer several return methods, depending on the country where you have placed your order:

All returns that are processed through the carrier offered by the company will incur costs that will be deducted from the final amount to be refunded. Below we specify the cost of return depending on the country in which you have placed your order:

    - Spain and Portugal: 9,99€.
    - Belgium, France, Italy, Luxembourg, Germany and the Netherlands:          14,99€.


    If you choose the Gift Card refund method, this cost will be free of charge for you.

    If you do not wish to manage your return via the methods offered, you can return the product to us at your own expense by selecting the desired carrier. These return costs will not be borne by Kalk. Please note that, not being a service offered by us, we cannot assume the risk on the returned package when it refers to causes not attributable to Kalk, so we recommend you keep a proof of shipment.

    All returns must be sent to our warehouse in Spain, whose address you will find on our Returns Portal.

    All countries that are not part of the European Union may generate custom fees. In order to avoid this charge we recommend indicating the parcel´s value as 0.00€ (RETURN). However, any expenses associated with the return will be the responsibility of the customer (DDP Incoterms®).

    Exchanges

    The free exchange service through our Returns Portal is only available for orders placed in Spain, Portugal, Belgium, France, Italy, Luxembourg, Germany, Netherlands: Our customers will be able to choose another size within 14 days from the date of delivery of the package.

    It is important to note that only one free size exchange is allowed per order, so if you wish to make another exchange, you will have to make a return (in which €19.99 will be deducted from the amount of your order if you choose our carrier) and place a new order with the desired item. You will also have the option of returning the product by your own means, in which case the cost of transport will be borne by the customer.

    For orders placed in the rest of the world, you must process the exchange as a return. Request the return through our Returns Portal and place a new order.

    Product Status

    For a return to be accepted by Kalk, it must meet the following conditions:

    1. They must not have been used.
    2. They have not been damaged in any way.
    3. They are in the same condition in which they were initially sent to the customer and retain the original packaging and all its contents (hang tags, papers and other items that may contain).
    4. The original box must not have been written on or have anything stuck to it.
    5. That the return does not contain Bikini Panties, swimming costumes, Piercings, Ear Cuffs, Earrings or Masks. These products will not be accepted.
    6. They have not been purchased through a 2x1 promotion.

    If any of the conditions listed in this section are not met, Kalk reserves the right to refuse the return.
    Once the return has been refused, the customer will have 3 months to pick up the package at our warehouse, assuming the shipping costs. If the package is not collected by the customer within 3 months, it will be sent to charity.

     

    Refunds

    For orders placed in Spain, Portugal, Belgium, France, Italy, Luxembourg, Germany, Netherlands:

     

    • Gift card: We will send you a gift card with shop credit for the amount of your returned items with no expiry date. This option is free of charge.
    • Refund: We will process the refund of your returned items to the same payment method used for your original purchase. A return fee will be charged for this option:

    Spain and Portugal: 9,99€.
    Belgium, France, Italy, Luxembourg, Germany and the Netherlands: 14,99€.

    For orders placed in the rest of the world:

    • Gift card: We will send you a gift card with shop credit for the amount of your returned items with no expiry date.

    The refund or gift card will be issued to you once the item has been received and the return has been approved and authorised.

    Once you have chosen the refund method, you will receive a return confirmation email. We will send you the gift card code if this is the chosen option or if you prefer the refund, you will receive notification of the amount of the product(s) to be returned. You will be refunded via the same payment method you used to pay for the order.

    The refund will appear in your account balance within 7 to 15 working days of receiving the return confirmation email, although this may vary depending on the conditions of each bank.
    Please note that in the case of gifts, refunds will always be made via the payment method used when placing the order.

    RIGHT OF WITHDRAWAL

    The consumer and user will have the right to cancel the order placed remotely without giving any reason, during a period of fourteen (14) calendar days from the correct reception of the product.

    Once the article has been received and the return has been approved and authorised, you will receive a confirmation email indicating that the amount of the product or products to be returned will be paid by the same method of payment used (unless the consumer has expressly provided otherwise and provided that the consumer does not incur any costs as a result of the refund). The total amount of the purchase will be reflected in your account within a maximum period of 14 calendar days from the time you have received the return confirmation email and depending on the conditions of each bank.

    The product must be returned in perfect condition, and without its use having gone beyond the mere verification of its good condition and functioning.

    All shipping costs corresponding to the return process shall be borne by the customer.

    In order to proceed with the withdrawal, we recommend that you register through our Contact Form and follow the instructions indicated there.

    In any case, we recommend that you keep proof of delivery.

    Use an envelope, bag or paper wrapping to protect the box containing the items to be returned and we recommend that you do not place the return label directly on the boxes, as it would be impossible for us to reuse them.

    Cancellation

    Every order placed in Kalk can be cancelled within 24 hours from the date of purchase through our Returns Portal. The refund will be processed to the same payment method used for the purchase and will be effective within 7 to 10 working days depending on your bank.


    RESPONSABILITY

    Kalk is committed to transfer your order as swiftly as possible to the selected transport agency. Nevertheless, Kalk cannot be held responsible for: damages resulting from a transport malfunctioning, especially for reasons such as industrial actions, traffic congestion and in general any other reason typical of the sector that derivate in delays, loss or theft of the chosen product. For technical failure, accidental causes or any other kind that may prevent the normal functioning of the service through internet. For lack of availability of the site for maintenance reasons or other that prevent the user from accessing the service. Kalk will use all available means to provide the process of selection, payment and shipment of the desired product. Nevertheless KALK declines any responsibility for third party causes, fortuitous circumstances and force majeure situations.

    INTELECTUAL PROPERTY

    All the information contained in the website, as well as the graphic design and layout and the code used, is protected by author’s right and other protection rights contained in the Real Decreto Legislativo 1/1996 disposition, of April 12th, in which the Texto Refundido de la Ley de Propiedad Intelectual is approved. These rights belong solely to Kalk or its licensees, so it is expressly forbidden any act of reproduction, distribution, transformation or public communication, as well as any type of cession of the whole or part of the website content, and in general of any object that according to current law may be protected by laws of intellectual property.
